Schumer's Supreme Assault

Senator Schumer’s threats against Supreme Court Justices Kavanaugh and Gorsuch irrefutably constitute the commission of a felony pursuant to 18 U.S.C. This type of threat usually carry a maximum penalty of 5 or 10 years under 18 U.S.C. § 875, 18 U.S.C. § 876, respectively. A threat made against a judge, constitutes obstruction of justice. The are three (3) elements to the crime: (i) transmission in interstate commerce; (ii) a communication containing the threat; (iii) and the threat must be a threat to injure the person of another. These threats are also punishable pursuant to the statutes criminalizing assaulting US Government employees. The courts have held that a ‘true threat’, it must be proved that a reasonable person to whom the threat is directed would consider it a threat under the circumstances. I think Chief Justice John Roberts' unprecedented rebuke is affirmation that this standard has been met.

What will happen to Senator Schumer? Nothing, of course. Just another affirmation of a two tier justice system hospitable to the lies, threats and coercion of the Left.
